In accordance with the Mexican Federal Law for the Protection of Data in Possession of Private Companies or Individuals (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) published on July 5, 2010, we inform you of the following information:

 

Hoxul Crypto Real Estate, SAPI de CV (hereinafter “Hoxul”), with address located at Blvd. Mariano Escobedo 4502-30, San Isidro, 37530, León, Guanajuato, México, is responsible for the processing and protection of your personal data. In compliance with the Mexican Federal Law for the Protection of Data in Possession of Private Companies or Individuals (the Law) and committed to the protection of your personal data, assuming the use, management and confidentiality of your personal data in accordance with the Law, and with the purpose of inform you the main characteristics of the treatment to which your personal data will be subjected, Hoxul issues this Notice of Privacy Practices available for you.

 

I. IDENTIFICATION OF PERSONAL DATA AND ITS ORIGIN.

Hoxul processes your personal data, that is, information that can reasonably identify you, and that may appear in various documents, whether printed or in digital format. The personal data that is collected and/or processed includes: name and surname; date and place of birth; identification and authentication data, data on physical characteristics and data on your state of health; nationality; address, whether private or work; phone number, whether home, work or cell phone; civil status; Tax ID or tax identification number; among others; contact data, patrimonial and/or financial data, tax data, demographic data, location data, migration data, labor data, academic and professional data, as well as technical information, characteristics (attributes, operations, identifiers, signals, configuration, network and cookies) and geographic location of the device you use to access Hoxul products and services.

 

II. CONSENT.

You consent to the processing of your personal data if you do not express your refusal for this purpose through the means that Hoxul makes available to you in this Notice.

 

For the treatment of personal data of minors, the consent of the parents or guardians is obtained through their signatures on contracts. Verification of the authenticity of the consent given by the parents or guardians is carried out by requesting their birth certificates, ID cards or voter credentials and proof of address.

 

III. PURPOSES OF THE TREATMENT.

The personal data subject to treatment will be processed to fulfill the purposes described in this section.

 

Primary purposes of the treatment.

Hoxul will process the personal data described in this Notice to conduct some or all of the activities necessary for the development and fulfillment of the obligations that originate and derive from the legal relationship with you, which include the following purposes:

 

  • Identifying you as a customer of Hoxul products and services.

  • Validate and verify your identity in accordance with Hoxul's internal policies and procedures.

  • Analyze your profile in order to determine if you are eligible to purchase certain Hoxul products and services and carry out credit risk and feasibility analysis, if applicable.

  • Serve as personal references, guarantees and/or beneficiaries, as well as to contact said third parties as personal and/or family references for collection purposes.

  • Conduct the investigations and necessary actions, in order to verify directly or through third parties contracted for it, dependencies, autonomous organisms or both federal and local authorities, the veracity and authenticity of the data and information provided, the foregoing through the use of different means available lawful including the consultation of portals belonging to publicly available Federal and/or State Public Administration Agencies and Entities.

  • Comply with obligations set forth in the applicable regulations and meet requirements formulated by the competent authorities.

 

Secondary purposes of the processing of your personal data.

Hoxul will process your personal data to conduct some or all of the secondary purposes mentioned below:

 

  • Manage customer service.

  • Conduct marketing, advertising, and commercial prospecting activities.

  • Manage the sending of advertising, notices, messages, news, invitations to events, via print or through electronic, telephone, physical and face-to-face means for promotional and marketing purposes.

  • Offer you, where appropriate, other products and services from Hoxul or from any of its affiliates, subsidiaries, holding companies, associates, commission agents or from any third party that is related to Hoxul.

  • Keep the data that you have provided us in order to contact you in follow-up to the requests initiated for contracting Hoxul products and/or services, in which you have expressed interest.

  • Invite you to participate and that you can participate in promotions, campaigns, contests, and other activities organized by Hoxul or any of its affiliates, subsidiaries, holding companies, associates, commission agents or any third party that is related to Hoxul and in case of being awarded prizes, benefits, make your delivery.

  • Let you know or invite you to participate in our non-profit activities of social commitment that aim to promote the development of people, through educational, social, ecological, and cultural projects.

  • Perform statistical analysis for the generation of information models and/or profiles of current and predictive behavior, and participate in surveys, giveaways, and promotions.

  • Participate in satisfaction surveys and opinion interviews.

 

IV. TRANSFERS OF PERSONAL DATA.

Hoxul may transfer your personal data to both national and foreign entities, without requiring your consent in the following cases:

 

  • To national and international companies affiliated, subsidiaries, controllers or controlled by Hoxul in the event that it is required to comply with the purposes set forth in this Notice of Privacy Practices, the foregoing in the understanding that said companies operate under privacy policies that comply with the corresponding applicable provisions.

  • To your guarantees, solely with respect to the condition of your current credit history.

  • Commercial partners with whom contracts have been entered into for the commercialization of products and/or services, for the benefit and/or interest of clients.

  • Courier companies to send communications related to the contracted products and/or services.

  • Debt acquiring companies with whom a portfolio sale contract is entered into.

  • Notaries Public for the instrumentation of credit operations, if applicable.

  • External lawyers to implement legal operations and/or follow up on credit recovery.

  • Companies that offer consulting and operational, administrative, financial, technological and software operation advisory services for the benefit of the services provided to you.

  • Competent authorities in the cases legally provided for compliance with legal and fiscal obligations of Hoxul.

 

V. MEASURES TO PROTECT PERSONAL DATA.

The personal data processed by Hoxul are protected by adequate administrative, technical, and physical security measures against damage, loss, alteration, destruction, use, access or unauthorized treatment, in accordance with the provisions of the Law and its Regulations.

 

VI. ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION (ARCO RIGHTS) OF THE USE OF PERSONAL DATA.

You can request Hoxul access to your personal data that it possesses, as well as the details of its treatment, to rectify it in case it is inaccurate or incomplete; cancel them when it is considered that they are not required for any of the purposes indicated in this Notice of Privacy Practices or they are being used for non-consensual purposes or the contractual or service relationship has ended, oppose their treatment for specific purposes, or , the revocation of the consent granted for the processing of your personal data in order to stop using them, the foregoing following the procedure established for this purpose, which is stated as follows:

 

The request must contain:

  • Name, address, and email to communicate the response to your request.

  • The documents that prove your identity, or where appropriate that of your legal representative.

  • The clear and precise description of the personal data for which you want to limit its use or disclosure.

  • Any other element or document that facilitates the location of the corresponding personal data.

Once the request to limit the use or disclosure of personal data has been received, Hoxul will have a maximum period of twenty business days to resolve the request; which will be effective within a maximum term of fifteen business days, counted from the date on which the response was communicated.

 

The procedure described above is free; Except for the justified shipping costs (packaging) that may be required, which may be borne by you. The aforementioned procedure is issued without prejudice to any other more expeditious mechanism that Hoxul may publish or state.

 

Transfer of personal data

It is Hoxul's policy to only disclose information to third parties under the following circumstances:

 

  • As established by law through subpoenas, search warrant or other legal process.

  • When it is considered necessary, personal information may be disclosed in the event that this is indicated by any law, to any authority or third party that needs it to comply with any obligation or legal request.

Hoxul reserves the right to make changes or updates to this Notice of Privacy Practices at any time, derived from new legislation, internal policies or new requirements for the provision or offering of our services or products.

VIII. COOKIES, WEB BEACONS, AND OTHER TECHNOLOGIES.
